About Heather

The Gazette does a good job today of reminding us that the person who actually started all of this — the “Heather” behind Heathergate — is still doing just fine, thank you, in her fancy, multi-million dollar out-of-state job.

It’s worth going back to ponder exactly what Heather did. It’s jaw-droppingly amazing, actually: Heather had one conversation with Paul Speaker where she alleges that he agreed to excuse her from HALF of her MBA coursework so she could be free to jet set around the country for her dear old friend Mike Puskar. (Course work for a graduate degree? Seriously, who can be burdened with such a quaint inconvenience?) She never ever follows up. She never makes a phone call, never sends an email, ANYTHING. She just begins representing herself as someone who has earned an MBA.

And gosh by golly, when someone dared to question her about it, she actually said that her word was “better than any transcript,” and that for anyone to accuse her of not earning an MBA degree was “offensive.”

Offensive.

Seriously, people — who the fuck does that? WHO? Certainly not a reasonable person:

No student should have a reasonable basis to conclude that he or she could or would be excused from so many outstanding credit and course obligations simply upon the basis of a single meeting without any follow-up.”

This really was one of the most shocking parts of the report, and it deserves more attention. If Heather really, honestly thought she had earned an MBA degree, that means she is either 1, dumber than a bag of hammers, or 2, because she’s HEATHER FUCKING MANCHIN, she feels a sense of privilege and entitlement that is SO deep and SO great, that literally, people like you and me cannot comprehend it.

I guess that’s what happens to your head when your entire family’s “success” is built on generations of political power.

And about that political power: it should turn your stomach to think that the Manchins used the state university — paid for by tax dollars and sky-high tuition — to get their daughter a fake MBA, and now she’s LITERALLY making 100 times what the average West Virginian makes in a year. And because she’s too good to live in West Virginia, we don’t even get a dime of that back in taxes. All we get is a big ugly scandal.

And all over a degree that Heather actually says (probably truthfully) that she never really needed. But it’s not about what she needed — she’s never needed anything in her entire life.

It’s all about what Heather MANCHIN thinks she deserves.

People still ask me what I think drew the Pittsburgh Post-Gazette to this story in the first place. Was it a tip? Who the hell knows. But let’s consider the obvious:

Most news junkies remember that Wall Street became concerned when Mylan — a company that contrary to popular belief, is actually headquartered right outside of Pittsburgh — bought up the generic arm of Merck. (Which incidentally, happened around the exact same time that Heather Bresch was promoted to COO.) Overnight, Mylan became a much larger company. A lot of people thought (and still think) that Mylan may have bit off more than it can chew. And investors are still unsure if the company’s leaders — including Heather Bresch — have it in them to run such a large operation.

Why, you might ask? Forget the fact that she doesn’t have an MBA. She doesn’t have a COO’s resume period. I challenge you to find ANY company of similar size in America that has ever promoted its Director of Public and Government Relations (business speak for “Head of Lobbying”) directly to Chief Operating Officer. It just doesn’t happen. We’re talking about 2 entirely different jobs, and 2 ENTIRELY different skill sets.

Directors of Public and Government Relations are almost always politically and socially connected schmoozers who know how to arrange political favors for their company. In other words, a pretty good job for a Manchin. The COO on the other hand, is literally the person chiefly responsible for managing the day-to-day operations of the corporation. It’s about as nuts and bolts of a job as it gets.

So. If you’ve ever wondered why anyone would take a second look at Heather Bresch’s resume — wonder no more.

    Wonder of wonders. I received a letter from Gov. Joe Manchin’s Office today. It looks like someone took the time to sign his name OR he signed himself. That is very nice.

    Now, in my letter to Manchin, I referenced my love for academics and my connections to WVU. I enclosed a copy of my vitae for his staff to reference to see my credentials–to make sure I was not some crackpot. They, however, took that to mean that I was recommending myself along with two other people for the WVU BOG. Enjoy the letter retyped below.

    Dear Mr. Austin:

    Thank you for your letter of recommendation for Dr. … , Dr. Charles Vest and yourself to be considered for appointment to the West Virginia University Board of Governors. I appreciate the time you took to send this letter.

    Scott Cosco assists me with appointments to boards and commissions, and I have informed him of this request. This information has been noted in our system and I assure you that these individuals will be given every consideration.

    Let me make it clear that I did NOT recommend myself, nor would I want to serve if asked. I will be in Scotland anyhow. But this letter sincerely made my day. I am going to frame it for a laugh.

    Josh, if you were older, you might also have a certificate from his uncle, A. James Manchin, making you a Commodore of the Ship of State. I’m among the thousands who have such a certificate. A. James sent them out when he was Secretary of State or something. I can only hope that I get a comparable letter from Joe Manchin so I can frame them together.

    You have to have been around during A. James’ era and done something that got your name in the newspaper I got mine after I won an award but for all I know, any mention in the paper was enough to get a certificate whether the mention was for something good or bad. If I run across mine, I’ll email you and get and address so I can send it to you. I don’t know that I still have it though.

    Lou: Thank you kindly. I am seriously happier than I have been in weeks. I heard legends about A. J. Manchin. About REEP and his panel trucks. About “losing” millions in state funds. About his bouts with the bottle.

    A.J. once dropped a crushed, spray-painted gold car off in the middle of Woodburn Hall one day. No one really knows why. Someone put a sign on it that said “Jimmy Hoffa is here.”

    I would consider it a great honor to be commodore of the ship of state! Who better to dub me. Wonder if the police blotter counted for the certificate…

    My daughter received one of those Ship of State Certificates from A .James Manchin. She was one of the star swimmers in a tots swim class, and he gave all the children a pontificating speech before presenting them with their certificates - something about being good citizens for learning to swim. My kid would always just jump in over and over, making a big splash. We arrived unawares of the visitor, and the college-aged teacher had his number right away. He asked me to make sure my kid kept jumping in right next to him. He got pretty wet! We just kept smiling and apologizing.

    For years he a memory of the blustery “man with the hat” who was dumb enough to come to swim class in a dress suit.

    Joshua’s letter is certainly a keeper!

    I’m quite taken with “the healing” comments. I guess what has happened is like being felled in the prime of life with a fatal disease - an act of God. If we show enough news reels and celebrate our greatness, it will all go away!

    That’s what I understood. PPG business reporters made a routine check with WVU Admissions and Records for the story about Bresch’s Mylan promotion. Little did they know . . .

    As far as I know, PPG checked credentials in October because they’re good reporters. I had heard, like Oaks, that it’s because the paper got burned on a past story and it’s now standard practice. I don’t know about ulterior motives. There could always be juicy extras or maybe they got lucky.

The one that stands out the most was when my cub scout pack was going to see the movie “The Jungle Book” at the old Capital Theater on Summers Street, back when they actually showed movies. He was there, and I remember playing one of the old table style Pac Man games with him. You know, the one where you sat across from each other. Anyway, he gave me and all of my fellow cub scouts a brand new shiny quarter. I guess he was starting to buy our votes early, huh?

    I think its safe to assume that princess Heather’s motivation to her claim was based on Wall Street’s questioning the cred of the Mylan senior management team post Merck acquisition. One thing I have not seen is exactly at what point did she begin this fabrication? What Mylan coporate and SEC docs were signed and when? If the timing of her claim to have an MBA coincided with the run up and eventual acquisition then there is another chapter to investigate of this sordid affair. When was the Mylan website updated to include her MBA?

    BOG meetings for 2008-09 have now been posted (http://bog.wvu.edu/meetings) but the date of the July meeting at which a new Chair is to be selected is not among the meetings listed. Surely they aren’t going to wait until the September 5 meeting to replace Steve Goodwin, are they?

    I’ve heard that some have suggested new BOG members need to live in WV because non-residents would need to travel to meetings. Note that of the 6 meetings, only 5 are in Morgantown and the sixth is a phone meeting. There are always at least two months between Morgantown meetings. Thus, I don’t buy that BOG members need to be WV-based because non-residents couldn’t be expected to travel as often as they would need to.

    The June 2009 meeting is not scheduled for Charleston. The June 2005, 2006 & 2007 meetings were all held in Charleston; I checked the posted minutes to confirm this. Do you suppose they decided that Charleston was not a hospitable environment after the June 2008 meeting?

    You can add to the original posting on HB that she never ever even applied for graduation. This is a step at every level that says, in effect, “I believe I have enough credits to graduate, here’s my $50, please issue my diploma.” The school then AUDITS the transcript to verify qualification for the degree and either approves the degree or sends a memo with questions.

    So, in effect, the “out of thin air” group actually gave HB something SHE NEVER ASKED FOR.

    Lou, isn’t that a rather sad commentary? The people we’re recommending for the BOG in many cases have agreed to serve if chosen. That should be enough to eliminate any concerns. To get to the next tier at WVU, perhaps we need advisers who have achieved in that sphere of influence.

    Looselips: I wrote Heather a letter in early January, asking her to step up and take responsibility to avoid the inevitable damage to WVU, etc, etc.
    Sent a cc to her mother.

    Didn’t receive a reply.

    I certainly don’t think she should be so shielded from all this fallout. But I also don’t think she will do anything about it. And, those inside Mylan and former mgmt there know things that they have no self interest in revealing.

    I do think her comfort zone should be smaller than it is now.

    The corruption represented by this effort to rewrite history disappoints me tremendously. If News and Information Services wanted this record to note that Garrison did not speak, they could have done so through a footnote. It is wrong to rewrite a previously issued release to suggest that Jennie Hunter-Cevera was the speaker originally selected. What else do you suppose they have rewritten?

    NIS employees, most of you are classified staff and have some protection from being fired because of that. I don’t think that a claim of insubordination because you refuse to rewrite history could stick. Start refusing to do this. If threatened because of that, post on this blog and contact HR’s Employee Relations office. This is simply wrong!!!!

    Heard on the street…….Heather’s husband (1 or 2?) threw her under the bus…..told Pittsburgh Post Gazette she had no eMBA, prompting the investigation. Also heard, Garrison threw Wise under the bus and from high official in WV government that Manchin is vindictive, going after people who oppose him. Looks like a breed of cats.

    If it’s true that any publicity is good publicity, Heather is doing very well, When you Google her name, you get 28,600 entries from a wide range of sources. There are pharmacy-related blogs and even a student loan blog entry as well as the usual newspaper articles, etc.

    She’s even got a Wikipedia entry - http://en.wikipedia.org/wiki/Heather_Bresch That’s something that I don’t have but if I were to have one and it read like hers, it’s something I’d pass on.

    I emailed Barry Minkow who replied right away. He said the Bresch situation would have definitely been one his group would have pursued. However, since they did not break the story, they would not take it up.

    I wonder if anyone is pursuing the legal aspects of this. There are certainly problems re: sworn SEC testimony.

    Thank you Charleston Gazette and HK for keeping attention on Heather Manchin Bresch. She and her father are the two people who should be most ashamed for making our flagship university look like a tipping canoe.

    I don’t forgive the President and his staff for what they did to cover for her, but Heather could have preserved everyone’s integrity by simply saying that she had failed to complete all the required steps and that she would be complying immediately so she could complete her degree.

    If she had had the simple honesty to make that statement, she could have completed her degree by whatever means was agreed to with the COB and the whole situation would have been avoided.

    On another note, I’ve started off my day playing hooky already, browsing the WVU photo archive. There are many photos of the logging industry, showing the dense virgin forests which were virtually exported to the eastern seaboard to build cities. An interesting photo shows a huge tree, partially hewn, that was used to build the Titanic. It appears to be at least 20′ in diameter.

    Logging, and other industries are the heritage of rape and pillage this state has experienced.

    The images cannot be copied and pasted, but some of you historians may be interested.

    I never knew about that photo archive. In fact, with “The Manchin Degree Scandal,” I am education myself more thoroughly about a lot of little nooks and crannies on the WVU home page, as well as others.

    It may be corny, but for a native WV’n it was great to see pictures of the virgin forest I’ve read about. Sad to see the intact forest behind naked scenes of deforestation. I also found anothe link somewhere that explains the chain of events from that, to fires, to floods, etc. I’d post it but wouldn’t want to bore anyone.

    Devastation in WV is no longer a huge felled tree, with Heather standing by with a saw. Intangible values are being destroyed, and we cannot snap a picture of the erosion and destruction.

    What is most impressive to me from the archive is that all that logging appears to have been forest cut by hand. There were trains and sawmills, but there was no power equipment. Each logger had a hand in it, and in time, they stripped the entire state by hand. Lessons to be learned, good and bad.

    Thanks for the Link to Metro News. Hoppy has never gotten it. Even when the facts were obvious, he didn’t get it when public health in Morgantown was under attack fifteen years ago. Why, because public health is in direct competition with WVU Health Sciences and the Mylan profit margin.

    Hoppy still doesn’t get it, because he is paid a lot of money not to get it.
    The link is obvious, Mylan advertises on WV Media Corporation outlets, where Hoppy works. Mylan pays big money to keep Mojo in office. Mylan gives WVU big money, for tangible research and development of products that Mylan then sells for huge profits. Manchin could have at least investigated why the cost of those health products are so expensive in West Virginia, but instead Manchin gave his daughters corporation a pass on any disclosure. Isn’t that against the law? Well yes, technically helping a family member profit raises ethics concerns, but Hoppy is paid by unethical people ripping of West Virgina and that is the liberal media bias. Liberally ripping off the people. It is perfectly reasonable to think that the corruption of the powerful in WV caused the Manchin Degree Scandal to happen - because it is as obvious as the corruption of the State Supreme Court by King Coal.

    I agree, but you can’t get directly to the source. Right now there is a BoG option for pressure. I don’t know anything about Manchin’s pass on disclosure regarding pharmacy costs in WV. If it is illegal, then those in that loop must get on the stick. All of us simply cannot go after every angle of a corrupt regime. Even those of you who seem to know all the angle’s can’t do it either.

    Heather has stupidly provided a chink in that armor, and it must be exploited. There could be years of mileage out of the Heather/Mike faux pas (by corrupt regime standards.)

    The State Journal article about R&V also eliceted comments from Dr. Butcher about the “hospital taking over the university” and vice versa. He seems to be on quite a slippery slope, and I wish I could understand it.

    Also, when you refer to investigating why drugs are so expensive in WV, are you talking about the kickbacks — er, uh — marketing promotions that reward physicians for prescribing certain drugs? I was under the impression that practice is done by the companies producing brand name drugs, not generics.

    All who are in a position to be checks and balances must stop with the apathy and speak out every time. Overlooking things that appear small is what got us here politically, as well as what “trains” generations of these people to think they are actually entitled to whatever they want.

    Now what are we to make of this next problem. The article tends to slant towards advocating contraception NEEDS to be given in the schools to thwart the epidemic and the heavily Catholic ideals need to be corrected by state mandated practices but the article also clearly states that these girls wanted to get pregnant. Contraception doesn’t work that way. These don’t appear to be accidents. What I want to know is how much of my tax dollars are going to be needed so that these pinheaded girls can live their lives. I am sure public assistance is going to be needed by many of them and others that also do this nonsense to pay for the hospital, childcare, school (mother and child), food, shelter, work assistance, earned income credits, etc. Personal accountability has gone out the window. Obama is going to have to raise taxes to pay for these things and the middle class is going to feel the brunt as more and more people become dependent on the government for their needs.     Ah, Karen, please note the Code of Ethics makes no mention of the Chief Operating Officer though I would believe it extends to the office. I do not remember who posted the comment but a meteoric rise from data entry clerk 15 years ago to COO with a stop in Government Relations is simply not the norm. I feel confident in saying that a review of the credentials of COOs at other companies including pharmaceuticals would indicate broader and deeper experience, including that of actually running a business operation.

    As for why the PPG looked into this, there has been some speculation on this site that someone inside the company made the call. Perhaps someone who knew the facts and did not appreciate the organizational changes being made by Coury after the announcement of the Merck acquisition. I believe the original announcement of her promotion did indicate she had the MBA. It has probably been changed.

    Ii is difficult to understand why Mylan has done nothing in the wake of the findings of the Panel. The fact that the degree may not have been necessary for the positions she held is really irrelevant. What is relevant is the misrepresentation of credentials. But Coury says he and the company stand behind her. So I do not expect anything will be done unless he is forced to do so under pressure from external sources, the BOD or shareholders.

    Yeah, I noticed that when I posted it. Top management would be responsible for misrepresentation of credentials according to the code of ethics. At the very least, they would need to acknowledge that a breach of ethics had occurred. Simply removing the MBA from the website and putting out a PR support blurb doesn’t meet the mimimum ethical requirements, ie, “to promote the making by others of”.

    Ethics require actions greater than the law. Mylan failed the test. They should either remove any code of ethics from their website (along with false credentials) or make a statement of responsibility.

    I’m going to ask them to do that. Very politely. Might even ask more than once. May get others to do that, too.

The Board of Directors will take that action, if they truly meant the words that they approved and published on their website.

    Sorry Fish, The funding of research is more speculative, I ment it as a rhetorical question, as in how much? I honestly don’t know the answer. Clinical trials, R&D, it is more than possible at a research hospital.
    I also have no proof that Mylan is only a generic manufacturer, nor do I know what all WVU Health Sciences is involved in, or for whom. Somebody knows. And We the people need to find out.

    20 million + in gifts with no strings, not likely in this day and age.

    I do know Manchin policy is costing seniors more for their prescriptions, the seniors got outraged at the increase last year and Manchin had to pull back some of the changes.

    His influence stopped the industry financial disclosure (below) and this pattern includes the fishy tent in the yard of the state capitol (not to forget to mention because of a retro-active decision by a fake meeting of the Capitol Building Commission) which nobody can get at the numbers on who donated, how much and when is the public going to be invited to the party at the tent? About as soon as we all have afordable health care? We do know this industry over prescribes so much of their crap that it is in our nations water supply, again without any investigation or disclosure by “our” government.

    The Manchin Degree Scandal is very serious, as it has tipped the ice berg into the light of day. It is a titanic scandal worth being really pissed about. (Thank you all for paying attention)

    Just start with fixing grades, evry serious just by itself. This is in the news today. A kid is facing 39 years of hard time for fixing his own grades - A kid, not a COO or a U President, just a kid:

    Sorry Fish, The funding of research is more speculative than fact, I ment it as a rhetorical question, as in how much? I honestly don’t know the answer. Clinical trials, R&D, it is more than possible at a research hospital.
    I also have no proof that Mylan is only a generic manufacturer, nor do I know what all WVU Health Sciences is involved in, or for whom. Somebody knows. And We the people need to find out.

    20 million + in gifts with no strings, not likely in this day and age.

    I do know Manchin policy is costing seniors more for their prescriptions, the seniors got outraged at the increase last year and Manchin had to pull back some of the changes.

    His influence stopped the industry financial disclosure (below) and this pattern includes the tent in the yard of the state capitol (not to forget to mention authorized because of a retro-active decision by a fake meeting of the Capitol Building Commission) which nobody can get at the numbers on who donated, how much and when is the public going to be invited to the party at the tent? About as soon as we all have afordable health care? We do know this industry over prescribes so much of their crap that it is in our nations water supply, again without any investigation or disclosure by “our” government.

    The Manchin Degree Scandal is very serious, as it has tipped the ice berg into the light of day. It is a titanic scandal worth being really pissed about. (Thank you all for paying attention)

    Just start with fixing grades, evry serious just by itself. This is in the news today. A kid is facing 39 years of hard time for fixing his own grades - A kid, not a COO or a U President, just a kid:

    And here is the link to the 2007 Annual Report of the Pharmaceutical Cost Management Council, where they recommended disclosure of industry reps.. this seems to be what Manchin killed with the heavy hand of corruption. Why no financial disclosure? Secrecy is certainly unethical in this state (see below).

Does anyone have access to one of those, or have they all been altered since the degree was withdrawn? If Carolyn Hampson at 12:36 is correct, though, you would think they would have been citing the MBA since at least 2001, when Ms. Bresch received her first important promotion.

    I am curious about this notion of a soft landing. I probably could guess the answer to this but please just amuse me. MG is a lawyer. Many of his defenders have said that he didn’t take the Presidency because of money, and in fact is taking a pay cut. So why is a soft landing either within the university or at a bank needed? Why would he want to stay on at WVU in any capacity after Sept 1, if he can make more in the private sector?

    I have to say though it takes a pretty big hairdo to think that a severance package is needed for doing a job in which you made “fatal” blunders in the first few weeks. No matter how you slice it, in one year MG became the worst President of all time at WVU. MG’s legacy: HB, RR, RV.

    Ok looking at those three things I am figuring out why he needs a soft landing.

    Secondly, you have not obtained a signed copy of the R/V contract, I presume. Hence, your directions have been misguided with hopes of letting the HSC alone. Therein lies the meat of this story. Do not forget to doggedly pursue this entity.

    Carolyn Hampson: Milan Puskar was still Chairman of the Board of Mylan as of the end of 2007. If the FTC had made him agree to have nothing to do with running Mylan, wouldn’t they have made him give up the Chairmanship? And he didn’t leave the CEO’s spot until September 2002, although the FTC case that I think you’re referring to was settled in 2000.

    If this whole mess becomes a movie or a musical, I think the theme song should be Loudon Wainwright’s “Dead Skunk in the Middle of the Road, Stinkin’ to High Heaven.” The song has been going through my mind like a broken record ever since this all began.

    We need a cartoon of the people at the heart of this mess stranded on a two-lane W. Va. road, standing by a Mercedes with a flat tire, with a dead skunk smack in the middle of the road in front of them on a hot, hot June 20 - West Virginia Day. The tire went flat after running over the hood ornament that blew off of Rodriguez’s car as he broke land speed records on his way to Michigan. They may never get the stink of that skunk out of their clothes.

    It’s clear from the stories that both Rivard and Kasey have seen the contract. The Kasey story indicates that it’s a two page contract. I’ve not seen any posting that has the contract itself. Do you know of any so we can all see it and have a clue as to what we’re missing?

    I did do a little digging and found some archived articles about HB/Mylan. She has had numerous titles: VP of strategic corporate development, VP for public relations, sometimes “executive” or “spokesperson.” Her testimony before the Senate did not list credentials. She casts a shadow on the entire company.

    As to how the PPG tumbled to checking up on HB’s credentials: As I recall, earlier in 2007, spring, I think, the PPG, when the Garrison for President farce was playing out, did an extensive, front-page, connect-the-dots article about Garrison’s political connections. That article was detailed in its proctological examination of the Goodwins (and was a source for the connect-the-dots sidebar accompanying the paper’s Dec. 21 blockbuster about the questionable degree). The political connections story was reminiscent of the extremely sound Sunday Gazette-Mail story from early 2001 describing the remarkable influence the Goodwins were exercising over key appointments in the Wise administration (band director Satterfield was the biggest eye-opener there) as the Great E-Mailer was making his rough (and weak, the Underwood Dems in the House almost beat him) transition from Congressman to Governor. Think it’s safe to say the PPG had its sniper sights trained squarely on all the key moving targets when, on or about Oct. 7, that little press release from Mylan came squirting out of Cannonsburg.

    Have always heard that when the House of Delegates was writing the legislation aimed at reducing pharmaceutical drug costs (when Wise was governor), it was mystifying as to why Mylan was spurning requests that they “come to the table for their input so they, as a generics producer, would be ‘taken care of’ but also provide professional expertise in helping craf the legislation.”

    The reason? Always heard it was because at that time Mylan (HB was the head of lobbying at the time and her dad was revving up his ‘04 campaign) was quietly preparing to move into the generic drugs market through this acquisition (from Reuters, May 13, 2007): Merck KGaA sells generics unit to Mylan for $6.6 bln

    Does this alter what you said? Maybe Merck doesn’t do business with WV physicians. I have no idea.

    Mike Puskar is still Chairman of the Board at Mylan so I am not sure I understand the notion that he had to “recuse” himself from the company. Robert Coury is Vice-Chairman and Heather’s boss. This is the key relationship within Mylan at this time.

    I believe I read that the first public representation of MBA occurred in 2006 when she spoke/testified before a Congressional committee or sub-committee in Washington, DC. And it continued from there. Undergrad degree from WVU in Political Science and International Relations as I recall. No emphasis on business.

    As I have said before, the silence out of the Mylan offices and the Governor’s mansion has been deafening. To sit by and do nothing smacks of approval and silent consent to what has passed. To not apologize for what has happened to WVU, its reputation and the reduction in the value and perceived validity of each grad’s diploma is beyond the pale. At what point do ALL of the those at the center of this scandal suffer the consequences for their actions, and not just the few who have gone down so far?
